Limited number of revamped Modern Awards operative from February 2020

It is hard to believe, but the 4 Yearly Review of the Modern Awards which commenced way back in 2014, continues to trundle along before the Fair Work Commission (FWC). There are signs though, that the process is likely to reach a conclusion in 2020, with around 30 re-vamped Modern Awards released and scheduled to come into force from February.

Casual’s employment not “automatically terminated” by 7-week overseas holiday

A casual medical receptionist whose employment ended following her notified absence on seven weeks’ leave for an extended overseas holiday, has been awarded over $8,000 in compensation with the Fair Work Commission (FWC) finding she was summarily and unfairly dismissed, rather than her employment having “automatically terminated” after three weeks absence as the employer mistakenly believed.

Man Files Stop Bullying Application Against Fair Work Commission

An applicant describing himself as a ‘lay advocate in past and current proceedings’ before the Fair Work Commission has filed an anti-bullying application in the Fair Work Commission (FWC).  Unusually, the application is made against the FWC and 25 people.  Those 25 people consist of 19 existing members of the FWC, four retired members and two management employees or officers.

Crane Driver Who Shut Down Crane and Left Building Site Without Telling Anyone Loses Unfair Dismissal Claim

An crane driver sacked from his job on a 39-storey residential development in Adelaide has lost his unfair dismissal claim after the Fair Work Commission (FWC) agreed with his employer’s submission that his conduct in shutting down the crane and leaving the site at noon without telling anyone was the equivalent of a ‘two fingered salute’ to the employer.

Christmas Eve declared part-day Public Holiday in Queensland

On 27 November 2019, the proposed legislation to enshrine 6pm – midnight on Christmas Eve as a public holiday was passed by Queensland Parliament. The approval of the Bill had been anticipated, given the recommendation of the Education, Employment and Small Business Committee that the proposed legislation be passed, despite the fact it was universally opposed by employer groups during the consultation process.
