A former employee of Masonic Care Tasmania has had her application for an unfair dismissal remedy dismissed by the Fair Work Commission (FWC). The Applicant, who had been given the benefit of several warnings and a performance management plan, was ultimately dismissed over conduct concerns.

A 74-year-old handyman whose employer told him he should be enjoying his retirement has been reinstated after the Fair Work Commission found his dismissal was unfair.
REMINDER: Xmas Eve declared part-day Public Holiday in Queensland
On 27 November, during the final parliamentary sitting week for 2019, Queensland Parliament passed legislation to amend the Holidays Act 1983 to provide for 6pm – midnight on Christmas Eve to be classified as a gazetted public holiday across the State. This part-day public holiday applies across all industries, to all businesses.

A casual medical receptionist whose employment ended following her notified absence on seven weeks’ leave for an extended overseas holiday, has been awarded over $8,000 in compensation with the Fair Work Commission (FWC) finding she was summarily and unfairly dismissed, rather than her employment having “automatically terminated” after three weeks absence as the employer mistakenly believed.

Man Files Stop Bullying Application Against Fair Work Commission
An applicant describing himself as a ‘lay advocate in past and current proceedings’ before the Fair Work Commission has filed an anti-bullying application in the Fair Work Commission (FWC). Unusually, the application is made against the FWC and 25 people. Those 25 people consist of 19 existing members of the FWC, four retired members and two management employees or officers.
